Terms of Service

Version Version 0.1 - Effective July 1, 2025

Introduction

These Terms of Service govern your use of this platform. By accessing the site or using any features, you agree to these terms. If you do not agree, you may discontinue use at any time.

Jurisdiction

This platform is intended for use by organizations and individuals located within the United States. We do not knowingly offer services to users outside the U.S., and we make no representations that the platform complies with laws or regulations outside U.S. jurisdiction.

  • Users outside the United States may not be eligible to register, subscribe, or access platform features
  • We do not collect or remit taxes outside the U.S., and international use may violate local laws
  • Any access from outside the U.S. is at the user’s own risk and subject to U.S. law

We reserve the right to restrict or terminate access for users located outside the United States at any time.

Account Creation and Eligibility

Platform access is granted through either direct subscription purchase or invitation by an active subscriber.

  • Subscribers: Individuals who purchase a subscription and open an account on behalf of their organization. These users take ownership of the platform setup and data.
  • Assigned Users: Team members (e.g. marketing directors) who are granted access by a subscriber. These users may manage organization tasks and initiate outreach but do not purchase subscriptions directly.

Board members may be invited to participate in quizzes and planning tools via email or personal contact, but they do not create platform accounts. Their data is managed by the account holder or assigned user.

User Responsibilities

Users with active accounts—either as subscribers or assigned team members—are expected to engage with the platform in a way that supports their organization’s fundraising efforts and respects system integrity.

  • Use board tools (e.g. quiz, idea selection, task tracking) only for their designated organization
  • Enter board member information (name and email) responsibly and only with permission
  • Initiate quiz invitations or sessions with board members in good faith
  • Maintain accurate tracking, delegate tasks honestly, and avoid misrepresenting board participation
  • Avoid submitting false, misleading, or unauthorized data

Users are responsible for ensuring their board interactions reflect real engagement and that their use of suggestions or plans generated by the system aligns with actual organizational goals.

Prohibited Conduct

To maintain the integrity of our platform and community, users must refrain from:

  • Submitting false or misleading board member information
  • Inviting or impersonating board members without consent
  • Using another organization’s subscription without permission
  • Attempting to circumvent quiz logic or misrepresent fundraising engagement
  • Accessing or manipulating data outside of assigned organization scope
  • Sharing login credentials or allowing unauthorized access
  • Uploading malicious code or disrupting system performance
  • Using the platform for purposes unrelated to legitimate fundraising planning

Violations may result in access suspension or account deletion without notice.

Content and Intellectual Property

All materials provided through the platform—including quizzes, fundraising suggestions, planning tools, and visual assets—are the intellectual property of the platform operator and protected by applicable copyright, trademark, and other laws.

Users may contribute content such as quiz responses, selected ideas, task progress, and profile information. While your account is active, you retain the right to review, modify, or delete this content.

Contributed data becomes part of the platform’s operational database and may be aggregated, stored, or processed to support system functionality. You acknowledge that the platform operator maintains technical ownership of the data infrastructure, content hosting, and service logic.

The platform’s structure, workflows, algorithms, and generated content—including text, images, and fundraising plans—may not be copied, distributed, or repurposed outside the platform environment without written permission. These materials are intended solely for use within the subscribed organization.

  • Authorized users may use generated content for internal planning and outreach only.
  • Board member quiz responses are confidential and may be accessed only by the inviting organization.
  • User-generated content (e.g. custom plans, board notes) remains the property of the submitting organization but may be used to improve platform services.
  • Commercial resale, publication, or external distribution of platform content is strictly prohibited.

If the service is suspended, discontinued, or modified, the platform operator reserves the right to retain, archive, or delete user data without obligation to provide copies or ongoing access.

By using the platform, users acknowledge that all intellectual property rights in the system and its outputs are reserved by the platform operator. Unauthorized use may result in account suspension or legal action.

Account Deletion and Access Termination

Users may delete their own accounts at any time through the platform interface. No approval or contact with administrators is required.

  • Account deletion is permanent and cannot be reversed
  • Deleted accounts lose access to all platform features and stored data
  • If a subscription owner deletes their account, all associated organization data—including board member records, quiz results, and planning tools—will be deleted

The platform operator may also suspend or delete accounts in response to violations of these Terms, loss of eligibility, or system misuse. In such cases, access may be revoked without prior notice.

Deleted accounts are not retained for restoration and may be removed from system backups at the platform operator’s discretion.

Automatic Account Deletion

  • Accounts with unverified email addresses may be deleted after 7 days.
  • Accounts that are created but never logged into may be deleted after 30 days.
  • Accounts inactive for 3 months and not linked to any subscription (owned or assigned) may be deleted.
  • Accounts inactive for 6 months with a canceled subscription may be deleted.
  • Accounts with active or assigned subscriptions will not be deleted.
  • Any account flagged for deletion may be removed without notice, unless reactivated by login before deletion occurs.

Payment Processing

All subscription purchases are processed securely through Stripe. Users are redirected to Stripe’s checkout environment to complete payment; no payment information is collected or stored by the platform.

  • Subscription access begins once payment is confirmed by Stripe
  • Renewals and cancellations are managed through Stripe’s interface
  • Receipts and billing details are issued directly by Stripe

By using Stripe, users agree to Stripe’s Terms of Service and Privacy Policy. The platform operator is not responsible for issues arising from Stripe’s systems, including payment failures, delays, or account errors.

If your payment appears successful on Stripe but your platform access does not reflect the change, please contact support. We’ll verify your subscription status and resolve any sync issues promptly.

All prices are listed in U.S. dollars unless otherwise noted. Taxes may apply based on location and will be calculated during checkout.

Refunds and Subscription Abuse

We aim to be fair and transparent with all subscribers. If you cancel your subscription due to a system issue or platform malfunction, you may be eligible for a pro-rated refund for the unused portion of your billing cycle. Refunds are not automatic and must be requested through support. We’ll evaluate each case individually and strive to resolve issues promptly and respectfully.

  • Refunds apply only to active subscriptions and must be requested shortly after cancellation
  • Refunds are calculated manually based on the remaining time in your billing cycle
  • Stripe does not automatically issue refunds upon cancellation; access typically continues through the end of the billing period
  • We do not offer refunds for accounts suspended due to violations of these Terms

To protect against misuse, we monitor subscription activity. Repeated cancellations and resubscriptions may result in account review or access restrictions. This includes patterns that generate excessive transaction fees without meaningful platform use.

We reserve the right to limit resubscription attempts, enforce cooldown periods, or deny access to users who abuse the subscription system. These measures help maintain platform integrity and ensure fair access for all users.

Platform Availability

We strive to maintain reliable access to the platform, but availability may be affected by scheduled maintenance, system updates, or external service disruptions.

  • The platform is generally available 24/7, excluding planned maintenance and unforeseen outages
  • We do not guarantee uninterrupted access or specific uptime percentages
  • Scheduled maintenance will be announced in advance whenever possible
  • Availability may be impacted by third-party services such as hosting providers, email systems, or payment processors
  • We are not responsible for downtime caused by external systems or force majeure events

We monitor system performance and aim to resolve issues promptly. If you experience persistent access problems, please contact support so we can investigate and assist.

Data Availability and System Failures

While we make reasonable efforts to preserve system stability and user data, we cannot guarantee data continuity in the event of a database failure, corruption, natural disaster, or technical interruption beyond our control.

By using the platform, you acknowledge that data stored in the system is hosted as part of a service, not guaranteed or backed by data recovery warranties. If records are lost, interrupted, or damaged, we are not liable for data restoration or individual record recovery.

We recommend keeping external records of critical activity as needed for personal or board documentation.

Modifications to Terms

These Terms may be updated as needed. When changes occur, the new version will be posted on this page with an updated effective date. Continued use of the platform indicates acceptance of the latest version.

Governing Law

These Terms are governed by the laws of the United States and the state in which the board organization is headquartered. Disputes may be resolved through internal board channels or applicable legal processes.

Version and Update Policy

These Terms of Service may be updated due to system changes or legal requirements. Users may be prompted to accept the updated policy before continuing to use the site. Acceptance is tracked in your account for transparency.
